Terms and Conditions of Use

Introduction

These Terms and Conditions (“Terms”) govern access to and use of the United Kingdom Process Server Directory (UKPSD) (“the Directory”, “we”, “us”, or “our”).

By accessing or using the Directory, you agree to be legally bound by these Terms. If you do not agree, you must not use the Directory.

Nature of Service

UKPSD operates solely as an online directory platform.

  • Do not employ, vet, regulate, or endorse any listed individual or organisation
  • Do not act as agent, intermediary, or contracting party between users and subscribers
  • Provide listings based on information supplied by subscribers

Inclusion in the Directory does not constitute a recommendation, endorsement, or approval.

Listings and Subscriptions

To create a listing, users must use the website sign-up function.

By submitting a listing, you:

  • Warrant that all information is true, accurate, complete, and not misleading
  • Agree that we may review, amend, refuse, suspend, or remove any listing at our sole discretion
  • Accept responsibility for keeping your listing up to date

You remain solely responsible for:

  • All activity conducted via your account
  • Ensuring compliance with all applicable laws and regulations

We reserve the right to remove listings without notice where reasonably necessary.

Content and Intellectual Property

You retain ownership of any content submitted.

By uploading content, you:

  • Warrant that you own or have lawful authority to use it
  • Confirm it does not infringe any third-party rights

You grant UKPSD a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and publish such content within the Directory.

Disclaimer

To the fullest extent permitted by law:

  • The Directory is provided on an “as is” and “as available” basis
  • We make no representations or warranties, express or implied, regarding:
    • Accuracy or completeness of listings
    • Competence, integrity, or suitability of any subscriber
    • Availability or reliability of the website

UKPSD accepts no liability for:

  • Any loss, damage, or claim arising from reliance on the Directory
  • The acts, omissions, negligence, or misconduct of any listed party
  • Errors, inaccuracies, or omissions in published information

Use of the Directory is entirely at your own risk.

No Legal Advice

Nothing contained within the Directory or on this website constitutes legal advice.

UKPSD:

  • Is not a firm of solicitors
  • Does not provide regulated legal services
  • Does not advise on legal rights, procedures, or strategy

Any information provided is for general informational purposes only and should not be relied upon as a substitute for professional legal advice.

Users should seek independent legal advice from a qualified solicitor or appropriate professional before taking or refraining from any action.

User Due Diligence

Users must undertake their own independent due diligence before instructing any listed individual or company.

This includes (without limitation):

  • Verifying identity, qualifications, licences, and insurance
  • Ensuring compliance with applicable laws
  • Assessing competence and suitability

You acknowledge that you rely solely on your own judgement when engaging any subscriber.

Complaints

If a dispute arises:

  • You should first attempt to resolve it directly with the subscriber
  • If unresolved, you may notify UKPSD

We may, at our discretion:

  • Review complaints
  • Facilitate informal resolution
  • Suspend or remove listings

We reserve the right to terminate or suspend listings immediately or on short notice.

Disclosure and Barring Service (DBS)

UK subscribers may indicate whether they hold a valid Disclosure and Barring Service (DBS) check.

Unless expressly stated, UKPSD:

  • Does not independently verify DBS status
  • Accepts no liability for inaccurate declarations

Responsibility for accuracy lies solely with the subscriber.

Limitation of Liability

To the fullest extent permitted by law, UKPSD shall not be liable for:

  • Indirect, incidental, consequential, or special losses
  • Loss of profit, business, reputation, or opportunity

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under applicable law

Availability of Service

We do not guarantee uninterrupted or error-free operation of the Directory.

We may:

  • Modify, suspend, or discontinue any part of the service
  • Restrict access at any time without notice

Acceptable Use

  • Use the Directory for unlawful or fraudulent purposes
  • Submit false or misleading information
  • Interfere with website functionality or security
  • Copy, scrape, or redistribute content without permission

Termination

We may suspend or terminate access to the Directory and/or remove listings at our sole discretion, without liability.

Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction over any dispute arising in connection with these Terms.

Changes to Terms

We reserve the right to amend these Terms at any time. Updated Terms will take effect upon publication.
